Liability and Privacy Policy

Limited Liability Agreement:
The applicant hereby agrees that the Indiana Telephone Relay Access Corporation (InTRAC) and/or the State of Indiana make(s) no warranties, either express or implied, regarding the possession, use, condition, and/or operation of the telecommunications equipment provided to applicant as part of this program (the Equipment). The applicant hereby agrees to indemnify, defend, and hold harmless InTRAC and/or the State of Indiana from all third-party claims, costs (including without limitation reasonable attorneys’ fees), and losses which in any way arise out of or in connection with the possession, use, condition, and/or operation of the Equipment. The applicant hereby agrees that InTRAC and/or the State of Indiana shall have no liability to the applicant or any other person with respect to any liability, loss, or damage caused or alleged to be caused, directly or indirectly, by or through the possession, use, and/or operation of the Equipment.

Indiana Telephone Relay Access Corporation (“InTRAC”) understands the importance of your privacy. This Privacy Policy applies when you visit our website at relayindiana.com (the “Website”), fill out our application for InTRAC services, use the InTRAC services, or interact with us in any way (collectively, our “Services”). By using our Services, you acknowledge you have read and understood this Privacy Policy.

When operating our Services, InTRAC collects Personal Information about you. The types of information we collect depends on your level of engagement with the Services. “Personal Information” means information that can reasonably be linked to a particular individual or household.

We collect Personal Information and data from a variety of sources, including directly from you and your interactions with our Services. The information we collect will depend on your level of interaction with us.  The information we collect includes:

  • Other information you voluntarily provide to us

InTRAC uses Personal Information for a variety of purposes, as described below. We use the information we obtain about you to:

  • Manage our business and provide our Services. InTRAC uses Personal Information to maintain user accounts, provide Services, facilitate usage of the Services, and complete necessary tasks to manage and provide our Services.
  • Conduct research and improve our Services. InTRAC uses Personal Information to conduct marketing research, such as questionnaires and surveys, and to analyze and enhance our marketing communication strategies.
  • Communicate. InTRAC uses Personal Information to communicate important information, including delivering notices to you about the use of our Services.
  • Ensure security and efficiency and to comply with the law. We may use Personal Information for other purposes with your consent or where permitted by law, for example to comply with applicable legal requirements, court orders, legal proceedings, document requests, industry standards, and our internal policies.

  • When you consent. InTRAC will not disclose your Personal Information to others without your consent, except as specified in this Privacy Policy.
  • With our service providers, contractors and vendors. We transfer all or a portion of your Personal Information to our contractors, service providers who help us deliver our products and Services to you and for the purposes described in this Privacy Policy.
  • For a reorganization. Personal Information we have collected may be disclosed to a third party in the event of a transfer of ownership or assets, bankruptcy, or other reorganization.
  • When we are legally permitted or required to do so. InTRAC may disclose without your prior consent Personal Information about you or your use of our Services if we believe disclosure is necessary or required by law.

InTRAC gives you options to access, edit, or delete certain information you have provided us, as well as choices about how we contact you. You can:

  • Access, Deletion, Correction. You may confirm the information we have collected about you, request correction of your contact information, or request deletion of your information by contacting us.
  • Email communications. You may control how you receive certain types of email communications by unsubscribing within the body of the communication. Note that some messages are required, service-related messages such as transaction confirmation messages, legal notices, or updates of which you may not opt out.
  • Do Not Track Signals. DNT is a privacy preference you can set in your web browser to indicate that you do not want certain information about your webpage visits collected across websites when you have not interacted with that service on the page. Because there currently isn’t an industry or legal standard recognizing or honoring DNT signals, we don’t respond to them at this time.
